This Privacy Policy is intended to inform you about how your personally identifiable information (“PP”) and other information is collected by us in operating the Website.

To assist you in reading our Privacy Policy, we have provided answers to the following frequently asked questions:

How does the Website work?
The Website offers visitors to the Website (“you” or “your”) the opportunity to browse the Website and use certain features on the Website. By using the Website, you consent to the collection and use of your information by MIYC as described herein. MIYC reserves the right to change how we handle the information we collect through the Website at any time. We will update this Privacy Policy to reflect any changes in our privacy collection and handling practices and will indicate that changes to this Privacy Policy have been made by listing a new date under “Last Modified” at the end of this Agreement. Such changes will take effect immediately once posted to the Website.

What type of PP does MIYC collect from you and how do we use it?
MIYC does not require you to provide us with any PP.  Unless you provide your PP to MIYC through the Website, we will not collect any PP from you. However, in order to use certain functionality (including, for example, to subscribe to our newsletters) on the Website, to participate in promotions offered from time to time or to purchase products through the Website, you will need to provide certain PP to us.

Under what circumstances may we share your PP?

MIYC will share your PP with other entities who work on our behalf or with us. These entities may use your PP to help fulfill your requests in connection with the Website and to help us communicate with you about different resources offered as part of the Website. Also, our parent, subsidiary and affiliate companies, or entities to which any of our assets, products, sites or operations may be transferred, will be able to use your PP.

On occasion, MIYC may share your PP with third parties for marketing purposes. Please note that it may take time for us to comply with your Opt-Out Request and, in the interim, we may continue to use your PP as described in this Privacy Policy.  In addition, please note that after receiving your Opt-Out Request, we may continue to maintain your name and other PP to help us ensure we can honor such request, to communicate to you about your account, and for other purposes not related to direct marketing.

If we receive your Opt-Out Request after having shared your PP with a third party, MIYC may not be able to control use of such PP by such third party (or any other party to whom such third party may have transferred your PP).  In such an event you agree that MIYC shall not be responsible or liable, directly or indirectly, for damages or loss caused or alleged to be caused in connection with the use of such PP by any such third party or resulting from any such transfer or disposition.  If you are concerned about MIYC sharing your PP with third parties or otherwise transferring or disposing your PP, you should not provide your PP to MIYC.

We may also release your PP to third parties if we believe such release is necessary (i) to comply with the law (e.g., a legal process or a statutory authorization), (ii) to apply or enforce our user agreements, (iii) to protect our rights or property, (iv) as part of a corporate reorganization, consolidation, merger, or sale of substantially all of the assets of MIYC, or (v) if we reasonably believe that a danger to any person requires disclosure of such PP. 

What other information does MIYC collect?
We also may collect anonymous and aggregate information from you about your preferences in navigating the Website by using cookies, action tags and other methods.  Cookies are small text files that identify your computer.  We may use cookies to, among other things, monitor Website usage, customize Website features, identify your computer’s operating system and browser, and complete transactions.  An action tag is a small, graphic image on a webpage that is designed to allow the website owner or a third party to monitor who is visiting a website by collecting the IP address of the computer to which the tag is sent, the URL of the webpage that the tag comes from and the time that such webpage was viewed.  Tags may be associated with cookie information.  We may also use such non-PP for promotional purposes.

Bounce Playground has engaged third party tracking and advertising providers such as DoubleClick to act on Bounce Playground’s behalf to track and analyze your usage of our sites through the use of cookies, pixel tags / web beacons, and similar technologies. These third parties collect, and share with us, as we may request, web site usage information about visits to our sites, measure and research the effectiveness of our advertisements, track page usage and paths followed during visits through our sites, help us target our Internet banner advertisements on our sites and on other sites, and track use of our Internet banner advertisements and other links from our marketing partners’ sites to our sites. The information collected on Bounce Playground’s behalf by these third parties does not contain your name, address, email address, or any other personally identifiable information. How do we store information?
While we take reasonable efforts to protect PP provided to us, we cannot guarantee that such information will not be lost, disclosed or accessed by accidental circumstances or by the unauthorized acts of others.

Does MIYC provide links to other websites?
MIYC may provide links to other websites or resources of possible interest to you.  Because we have no control over unaffiliated websites to which we provide links, the collection and use of your PP and other information by such websites shall be subject to the policies and procedures of such websites and not this Privacy Policy.

What are our policies regarding children?
You must be eighteen (18) years of age or older in order to use the Website.   MIYC does not knowingly collect PP from anyone under thirteen (13) years of age.

Covid-19 Disclaimer

The novel coronavirus, COVID-19 (including without limitation, any successor strains of novel coronavirus) (hereinafter referred to as “COVID-19”), has been declared a worldwide pandemic by the World Health Organization (“WHO”). COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. You represent and warrant that you have familiarized yourself with the most recent guidance and protocols issued by the WHO and the Centers for Disease Control Prevention (“CDC”) for slowing the transmission of COVID-19 and agree to comply therewith. You further represent and warrant that you have not: (i) traveled to a highly-impacted area subject to CDC Level 3 Travel Health Notice within the last fourteen (14) days, (ii) been exposed to any person returning from a highly impacted area subject to a CDC Level 3 Travel Health Notice within the last 14 days, or (iii) been exposed to any person who has a suspected or confirmed case of COVID-19. Finally, you agree to abide by any and all rules and COVID-19 protocols set forth by Bounce Playground (“Bounce”), Movies In Your Car (“MIYC”) and York College (“York”) for this event.

Notwithstanding any protocols put in place for the event, Bounce, MIYC and York cannot guarantee that you, and/or any of your family members or other individuals with which you are in contact will not become infected with COVID-19. Further, attending this event could increase your risk and/or your family members’ risk of contracting COVID-19. By completing your ticket purchase, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you and/or your family members with which you are in contact with may be exposed to or infected by COVID-19 by attending the event and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. You understand that the risk of becoming exposed to or infected by COVID-19 while attending the event may result from the actions, omissions, or negligence of yourself or others, including, but not limited to, Bounce, MIYC and York College employees and/or contractors. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself and/or any of your family members (including, but not limited to, personal injury, disability, and/or death), illness, damage, loss, claim, liability, or expense, of any kind, that you and/or any of your family members may experience or incur in connection with your attendance at the event (collectively, “Claims”). On behalf of yourself, and on behalf of your family members, you hereby release, covenant not to sue, discharge, and hold harmless Bounce, MIYC and York College and their employees, agents, parents, subsidiaries, assigns, contractors and representatives, of and from any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Bounce, MIYC and York College, their employees, agents, parents, subsidiaries, assigns, contractors and representatives, whether a COVID-19 infection occurs before, during, or after the event.
